Terms of Service

DRAFT for legal review · last updated 2026-09-06

1. The service

MockBoards ("the Service") is a web application for planning and scoring mock oral-board and OSCE-style examinations run by residency and fellowship programs ("Programs"). The Service is operated by the MockBoards operator ("we", "us").

2. Accounts and access

Programs are given an organization on the Service. Program administrators are responsible for who they add as administrators, examiners, and learners, and for keeping login links and codes private. You must not share credentials, attempt to access another organization's data, or probe the Service for weaknesses.

3. Your data

Programs own the data they enter: rosters, cases, schedules, evaluations, and reports. We process it only to provide the Service. Programs may export or delete their data at any time from the administrator console. We do not sell data and do not use it to train models.

4. Educational use only

Scores, pass/fail indicators, and reports produced by the Service are formative educational tools configured by the Program. They are not affiliated with, endorsed by, or predictive of any certifying board's examination, including the American Board of Emergency Medicine. Programs are responsible for how results are used in resident evaluation.

5. Availability

We aim for high availability but the Service is provided "as is" without warranty. Programs should download exam-day packets and keep them as a backup before the exam.

6. Acceptable use

Do not upload protected health information about real patients. Case materials must be de-identified or fictional. Do not upload content you do not have the right to use.

7. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from use of the Service. Our total liability is limited to the amount paid for the Service in the twelve months preceding the claim.

8. Changes and termination

We may update these terms with notice on the Service. Programs may stop using the Service at any time; on request we will delete an organization and all its data.

9. Contact

Questions about these terms: contact the operator through your program's administrator or the address given at sign-up.
